Why is trademark registration so important?

By registering your trademark or brand name, you will be entitled to receive the legal protection provided to the holders of trademark rights under trademark law. You will be able to exercise your trademark rights whenever a third party tries to use, file or register a trademark that is similar or identical to your trademark. Because if that was allowed to happen, there would be a danger of confusion between your trademark and that of the third party. After official registration has taken place, you will be able to take full advantage of the earning potential of your trademark.


Available options for trademark registration

For example, there are Benelux, European Union, international and national trademark registers. Once a trademark has been registered, in most countries it will usually be valid for a period of ten years after the filing date. The registration of the trademark can then be renewed an unlimited number of times for additional periods of ten years.


Criteria for trademark registration

After a trademark registration application has been submitted to the official agency, the application will be assessed by the agency. It is important to make sure that all the necessary details have been included in the application and that any descriptions and classification of goods and/or services are acceptable.


The official agency will then decide whether or not the trademark is eligible for registration. The criteria for this differ from one country to the other. Generally speaking, the trademark will be assessed for the following points:


  • It must be distinctive
  • It must not mislead the public
  • It must not be offensive or indecent


If a trademark does not satisfy any of these criteria, the application will be refused. It is possible to lodge an appeal against a refusal. If the grounds for the refusal can be remedied, then the publication of the application can go ahead.
