Designs portfolio management

Do you have a design portfolio consisting of various designs? Registering, monitoring and protecting your (international) intellectual property can be crucial for a valuation of how much your company is worth. With portfolio management, you can enhance the added value of your design portfolio within a set budget.

Portfolio management for designs

In consultation with you, NLO Shieldmark can help you effectively manage your design portfolio by:

  • establishing the value of the designs
  • identifying which designs are eligible for protection
  • determining the countries where design protection is needed.

Value for the business

If a design portfolio is not properly managed, you run the risk that you might not be investing in the right designs. An important aspect of portfolio management therefore consists of regular ‘pruning’ of the design portfolio by allowing design registrations with limited added value for the business to expire.

Careful selection

Another element of portfolio management consists of the strategic selection of designs that are eligible for protection. Which markets do you currently operate in and what are your competitors doing? How can you use your design portfolio to enhance your market share, both now and in the future?

Design protection: in which countries?

The registering, monitoring and enforcement of your design rights can be expensive if you are not careful. By carefully considering which countries you want to protect your designs in, you will be able to manage your design portfolio efficiently and cost effectively.

Considered portfolio management

When taking the above decisions, it is important to consider the following factors:

  • the (expected) commercial value
  • the (expected) effective protection
  • the geographical exploitation possibilities
  • the expenditure involved

An experienced design legal advisor who understands the relevant technical and commercial issues can help you to make a considered appraisal of these factors. NLO Shieldmark recommends that you analyse the issues detailed above in a systematic way at least once a year in order to make sure your design portfolio is being managed in the most effective way.

Fake invoices

Fake invoices are unfortunately a well known problem among trademark owners. A fake invoice is a misleading invoice (or letter) which reffers to a trademark, design, patent or patent application. A payment is requested for a publication in a register or to extend the validity of a registration. They use names like Worldwide database or Trademarks and Patents, Euro IP Register, International Patent & Trademark Database.
