Trademark portfolio management

Do you have a trademark portfolio with various trademarks, designs or patents? The registering, monitoring, and protection of your (international) intellectual property can be crucial for a valuation of how much your company is worth. With portfolio management, you can enhance the added value of your trademark portfolio within a set budget.

Portfolio management for trademarks

In consultation with you, NLO Shieldmark helps you effectively manage your trademark portfolio by:

  • establishing the value of your trademark portfolio
  • identifying which trademarks need protection
  • determining the countries where trademark protection is needed.

Value for the business

If a trademark portfolio is not properly managed, the costs will steadily mount up over time and you might not be investing in the right trademarks. An important aspect of portfolio management therefore consists of regular ‘pruning’ of the trademark portfolio by allowing trademark registrations with limited added value for the business to expire.

Careful selection

Another element of portfolio management consists of the strategic selection of trademarks and goods and/or services categories that need protection. Which markets do you currently operate in and what are your competitors doing? How can you use your trademark portfolio to enhance your market share both now and in the future?

Trademark protection: in which countries?

The registering, monitoring, and enforcement of your trademark rights can be expensive if you are not careful. By carefully considering which countries you want to protect your trademarks in, you will be able to manage your trademark portfolio efficiently and cost effectively.

Considered portfolio management

When taking the above decisions, it is important to consider the following factors:

  • the (expected) commercial value
  • the (expected) effective protection
  • the geographical exploitation possibilities
  • the expenditure involved

An experienced trademark legal advisor who understands the relevant technical and commercial issues can help you make a considered appraisal of these factors. NLO Shieldmark recommends that you analyse the issues detailed above in a systematic way at least once per year in order to make sure your trademark portfolio is being managed in the most effective way.

Fake invoices

Fake invoices are unfortunately a well known problem among trademark owners. A fake invoice is a misleading invoice (or letter) which reffers to a trademark, design, patent or patent application. A payment is requested for a publication in a register or to extend the validity of a registration. They use names like Worldwide database or Trademarks and Patents, Euro IP Register, International Patent & Trademark Database.
